Auto Theft

Auto Theft is the knowing taking, use, or attempt to take or use the vehicle of another with intent to either permanently or temporarily deprive the owner of a right to use the vehicle or a benefit from it, or to appropriate the vehicle to his or her own use or to the use of any person not entitled to the use of the vehicle. Auto Theft is grand theft, which is a criminal offense and a felony of the third degree. However, if the vehicle is valued at $20,000 or more, but less than $100,000, then it is grand theft in the second degree, punishable as a felony in the second degree. If the vehicle is valued at $100,000 or more, it is grand theft in the first degree, punishable as a felony of the first degree. To prove the criminal violation of Theft, the State Attorney must prove beyond a reasonable doubt that the criminal suspect knowingly and unlawfully obtained, used, endeavored to obtain, or endeavored to use the property of the victim, that he or she did so with the criminal intent to either temporarily or permanently deprive the victim of the right to the property or any benefit from it, or that he or she appropriated the property of the victim for his or her own use or for the use of any other person not entitled to the property.
